Attempted Sexual Assault at Gunpoint After a Robbery

In People v. Laboy, 227 Ill. App. 3d 654, 169 Ill. Dec. 692, 592 N.E.2d 179 (1992), the defendant was convicted of attempted aggravated criminal sexual assault and was sentenced to consecutive prison terms. The evidence revealed that the defendant first approached the victims with a gun and demanded money from them. The defendant became angry upon discovering that the couple had no money, and he ripped a gold chain off the female victim's neck. After completing the robbery, the defendant then decided to abduct the female victim and attempted to sexually assault her at gunpoint. The trial court found that the offenses were separate and distinct, and the appellate court affirmed. Laboy, 227 Ill. App. 3d at 665-66.
