Bolden v. State

In Bolden v. State, 51 Ill. Ct. Cl. 191 (1999), the Claimant contended that the damage was caused by another inmate placing live electrical wires together that were in plain view and were known by IDOC staff to present a problem. The gist of that claim was IDOC's alleged negligence in allowing inmate occupancy of a cell in which such electrical problems were known to exist. The Court denied the claim because there was no showing that IDOC was negligent, and the true cause was the misconduct of other inmates.
