In re Application of Anaya

In In re Application of Anaya (1981), 35 Ill. Ct. Cl. 540, the Court also denied a claim for compensation under the Act for the death of a victim who was not engaged in contributory behavior at the time of his death. The Court found that despite the lapse in time between the beating of the killer by the victim and the death of the victim by shooting, the victim had still contributed to his own death in such a manner as to bar the claimant's recovery, per section 80.1(d).
