Lawsuit Against School District for Negligent Hiring of a Bus Driver Who Committed a Sex Crime

In Giraldi v. Community Consolidated School District No. 62, 279 Ill. App. 3d 679, 665 N.E.2d 332, 216 Ill. Dec. 272 (1996), the plaintiff sued a school district for negligent hiring after its bus driver sexually abused a student. The bus driver's prior work history only showed that the driver had a tendency to be late. "But it wasn't tardiness, absenteeism, or irregular schedules that caused harm to the victim." Giraldi, 279 Ill. App. 3d at 691. Thus, this court concluded that there was no "factual or logical relationship between that knowledge" and the abuse of the victim. Giraldi, 279 Ill. App. 3d at 692.
