People v. Leroy

In People v. Leroy (2005), 357 Ill.App.3d 530, 828 N.E.2d 769, 293 Ill. Dec. 459, the court considered the constitutionality of an Illinois statutory prohibition against convicted sex offenders living within 500 feet of a playground or a facility providing programs or services exclusively directed toward persons under the age of 18. Leroy asserted that the statute violated his fundamental constitutional right to live with his mother and enjoy her support within 500 feet of a school. The court concluded that "no such fundamental right exists." Id. at 534.
