Protective Insurance Co. v. State

In Protective Insurance Co. v. State (1994), 46 Ill. Ct. Cl. 86, there was an award for Claimant arising from a vehicle accident after Claimant's vehicle was deliberately driven onto a shoulder which was later determined to have a drop-off from the highway pavement six inches deep that extended for approximately one mile on either side of the accident site. The evidence was that the drop-off had existed for at least three years and possibly ten years. Expert witnesses testified that the six-inch drop-off was an unsafe condition that contributed to the accident. A large award was made to the Claimant.
