Softcheck v. Imesch

In Softcheck v. Imesch, 367 Ill. App. 3d 148, 855 N.E.2d 941, 305 Ill. Dec. 425 (2006), the plaintiffs alleged they had been sexually abused by priests at a parish school. The complaint alleged that the defendants had assured the plaintiffs that participation in these acts were in keeping with the teachings of the church. While the reviewing court affirmed the dismissal of the complaint as untimely, the court also held that the allegations of the complaint did not require the court to "pass judgment" on church doctrine. The court pointed out that the trier of fact's determination was limited to whether the church taught what the plaintiffs alleged it taught; the trier of fact could find that the plaintiffs believed what the church taught, without having to determine whether the beliefs were valid or acceptable.
