Tully v. Edgar

In Tully v. Edgar (Ill. 1996), 171 Ill. 2d 297, 215 Ill. Dec. 646, 664 N.E.2d 43, a voter challenged an act that replaced the elected board of trustees of a university with an appointed board in the middle of the trustees' term. The Illinois Supreme Court held that legislation that nullifies the voters' election results by eliminating the right of the elected board to serve implicates the fundamental right to vote. Id. Thus, strict scrutiny was applied. Id.
