Kalamazoo Oil Co v. Boerman

In Kalamazoo Oil Co v. Boerman, 242 Mich App 75; NW2d (2000), the Court held that under certain circumstances, admission of evidence of comparative negligence during the damages phase of proceedings is appropriate; the decision to admit such evidence is within the discretion of the trial court. In Boerman, the Court held that given the facts, the trial court did not abuse its discretion by precluding introduction of evidence of comparative negligence. Id., slip op, 7-8.
