People v. Davis

In People v. Davis, 216 Mich App 47, 53; 549 NW2d 1 (1996), the prosecution presented testimony that the defendant pointed a gun at his former girlfriend's boyfriend and that the defendant warned the boyfriend not to come any closer or he would kill him. Id. The defendant then pulled the trigger several times, but no bullets fired. Id. The Court held that the testimony was sufficient for a reasonable trier of fact to find that the prosecution established all the elements of assault with intent to commit murder beyond a reasonable doubt. Id.
