People v. Jansson

In People v. Jansson, 116 Mich App 674, 687; 323 NW2d 508 (1982), the offense of CSC III was accomplished by force or coercion. The Jansson Court stated that the question of consent is not necessarily implicated in a decision as to whether the defendant was armed with a weapon, but the issue of consent is necessarily implicated in a determination of whether the act was committed by force or coercion. Id. at 687.
