People v. Leverette

In People v. Leverette, 112 Mich App 142, 151; 315 NW2d 876 (1982), the prosecution committed misconduct in asking the jurors to consider whether, if they were the victim, the fact that they were the only witness to the crime would preclude conviction. Id. at 150. The Leverette Court found that this argument was improper because the argument "implied that the jury should convict out of sympathy to the victim." Id. at 151.
