People v. Young

In People v. Young, 212 Mich App 630, 642; 538 NW2d 456 (1995), remanded on other grounds 453 Mich 976 (1996), the prosecutor learned how a witness would testify shortly before trial but did not inform the defendant of the nature of the testimony prior to trial. Since defendant had independent knowledge of the testimony, however, the Court found no abuse of discretion in the trial court's decision not to strike the testimony. Id.
