State Hwy Comm v. Vanderkloot

In State Hwy Comm v. Vanderkloot, 392 Mich. 159, 170; 220 N.W.2d 416 (1974), the Supreme Court of Michigan analyzed the "necessity" standard contained in MCL 213.368; MSA 8.261(8) of the highway condemnation act and concluded that the "necessity" standard set forth in that act was sufficient "to satisfy the demands of due process with respect to delegation of legislative authority." The Court explained that standards prescribed for guidance need only be "'as reasonably precise as the subject matter requires or permits.'" Id. at 173.
