Chimes v. Oritani Motor Hotel, Inc

In Chimes v. Oritani Motor Hotel, Inc., 195 N.J. Super. 435, 480 A.2d 218 (App.Div.1984), the court relied upon the reasoning of the California Supreme Court and held that an alternative dispute resolution provision in a contract was unconscionable and unenforceable. The court noted that "our Supreme Court has granted relief from provisions in contracts that are against public policy and are not freely negotiated because of unequal bargaining power of the parties." Id. at 442, 480 A.2d 218.
