In re Wiggins

In In re Wiggins, 242 N.J. Super. 342, 343, 576 A.2d 932 (App.Div.1990), in addition to terminating the provisional employee, the county employer further requested that the Board remove that employee's name from the eligible list. The Court held that a hearing on that issue was warranted, "as a matter of fundamental fairness and administrative due process," due to the "intensely factual determination" as to whether the employee's work performance was unsatisfactory. Id. at 345-46, 576 A.2d 932.
