Straley v. United States

In Straley v. United States, 887 F. Supp. 728 (D.N.J.1995), defendant broker took title to a garbage truck, but argued that it was not liable for injuries caused by the truck because it had never inspected or taken physical possession of the truck. The court rejected defendant's argument, stating that defendant could not "hide behind" the label of broker--"the fact that defendant never took physical possession of the truck could not negate the fact of its ownership or its subsequent placement of the truck into the stream of commerce." Id. at 743-44.
