In Zelma v. Total Remodeling, Inc., 334 N.J. Super. 140, 756 A.2d 1091 (Law Div.2000) plaintiff alleged, as he does here, that the defendant in that case had violated the TCPA by calling plaintiff in disregard of his request to be placed on a "do-not-call" list. The court rejected the defendant's motion to dismiss, ruling that it did have subject-matter jurisdiction. Id. at 142-43, 756 A.2d 1091.
