In 81 Russell St. Assocs. v. Scott, 163 Misc. 2d 984, 625 N.Y.S.2d 400 [App Term, 2d Dept 1995] the landlord failed to prove at trial that a building containing six residential units and a store, all of which were vacant, was substandard or deteriorated at the time the renovations were done. And in that case, the landlord spent between $275,000 and $300,000 on the renovations.
