In Agoado Realty Corp. v. United Int'l. Ins. Co., 95 NY2d 141 [2000] the Secretary of State sent notice to the insured's attorney/agent, but the attorney/agent had died; and the insureds claimed they were unaware of the attorney's death. The Court of Appeals held that it may have been impracticable for the insureds to find out about the lawsuit and give timely notice to the insurer (Id.).
