Aranzullo v. Seidell

In Aranzullo v. Seidell, 96 A.D.2d 1048, [2d Dept 1983], the Appellate Division, Second Department indicated that defendant's failure to comply with the Vehicle and Traffic Law could be excused by evidence that he had exercised reasonable care under the inclement circumstances in an effort to comply with the statutory provisions ( Id. at 691 [Defendant alleged to have crossed over center line and failed to reduce speed when approaching a curve in violation of Vehicle and Traffic Law 1180 and 1120]).
