Binh v. Bagland USA, Inc

In Binh v. Bagland USA, Inc., (286 A.D.2d 613 [1st Dept 2001]), the Appellate Division held that, a trial court "properly exercised its discretion in forgiving plaintiff's [three-month] delay in furnishing the errata sheet" correcting deposition testimony, and ruled that the "conflict between the original deposition testimony and the errata sheet raised an issue of credibility inappropriate for summary judgment treatment."
