In Bistany v. Bistany, 66 A.D.2d 1026 (4th Dep't 1978) the Court separated siblings where it was clear to do so was in their best interests. In that case also, the separation occurred for some time prior to trial and had worked out well. That Court ensured that its decision was based on the needs of the children at issue and not a compromise of the respective claims and feelings of the parents.
