In Bragg v. Genesee County Agric. Socy., 84 N.Y.2d 544 [1994], a motorcyclist was injured when he crashed on a trail that had been altered by the landowner's excavations within the last five months he had ridden the trail. The Court of Appeals found no willful or malicious intent upon the part of the landowner.
