Braham v. Braham

Braham v. Braham, 264 A.D.2d 418 (2d Dept. 1999), concerned a police officer who secretly taped his wife to gain an advantage in their divorce proceedings. When the wife discovered the tapes, he blocked her from leaving the room and then grabbed her. On another occasion, he took out his handcuffs and threatened to use them on his wife and to have her arrested. The Second Department agreed with the Family Court that the husband's offensive and frightening acts violated PL 240.26(3).
