In Brown v. City of New York, 264 A.D.2d 493 [2d Dept 1999], the Court found that the failure to raise the Notice of Claim defect in opposition to an application to vacate a judgment combined with waiting for a ten year statute of limitations to toll equitably estopped the City from raising the purported defect.
