In Burrows v. Union Free School District of the Tarrytowns, 250 AD2d 799 (2nd Dept. 1998) the court granted summary judgment to the sponsor of a school trip to an amusement park. Burrows, supra. The court held that defendant sponsor was not liable for an injury sustained by a student on a ride while at the amusement park insofar as defendant had no authority to control or supervise the ride and amusement park events.
