Byrn v. New York City Health & Hosp. Corp

In Byrn v. New York City Health & Hosp. Corp., 31 NY2d 194 (1972) the Court held that question of "whether the law should accord legal personality. . . in most instances devolves on the Legislature . . . ." (Id. at 201). It also observed that, "the Constitution does not confer or require legal personality . . . ; the Legislature may, or it may do something less, . . . and provide some protection far short of conferring legal personality." (Id. at 203).
