In Canigiani v. Deptula (59 Misc2d 401 [Dist Ct Nassau County 1969]), the court held that, even though the tenant did not obtain a pre-issuance stay by a deposit or payment, the court had the power to stay the execution of the warrant by reason of the Uniform District Court Act and CPLR 2201 (see 59 Misc. 2d at 403-04.)
