Carboline Company v. Gold

In Carboline Company v. Gold, 94 A.D.2d 921 (3rd Dept. 1983), the notice was filed against a corporation (Shaker Nine Realty Corp.), but when it was determined that the true owners of the property were three individuals doing business as Gibralter Sales Company, the Third Department allowed an amendment noting that the same three individuals owned the named corporation, concluding that the "misdescription of the true owners ... is the kind of failure which subdivision 7 of section 9 of the Lien Law is intended to protect".
