City of New York v. Falcone

In City of New York v. Falcone, 160 Misc2d 234 (App Term, 2d Dept 1994), the Civil Court, in a commercial holdover proceeding stayed a warrant of eviction for one year to allow the tenant to remove from the premises building materials, including more than three million bricks and sheetrock. The Appellate Term found, at 236, that "under the particular and unusual circumstances presented, the action of the court below was not an abuse of discretion."
