In Coronet Properties Co. v. L/M Second Ave., Inc., 166 AD2d 242, 560 N.Y.S.2d 444 (1st Dept 1990), plaintiff's summary judgment motion was denied because the court found that: defendants had set up a system of protection for adjacent structures; plaintiff's officer conceded that defendants had performed underpinning, bracing and shoring work; and even plaintiff's own engineer was unable to state that the damages were proximately caused by defendants' excavation.
