Dabbs v. State

In Dabbs v. State, 59 NY2d 213 [1983] the Court of Appeals - in affirming a judgment in favor of the plaintiff - held that insofar as the warrant upon which plaintiff's arrest was premised did not contain his name, the warrant was facially defective in that it did not comply with CPL 120.10(2), and, therefore, did not provide the police with the requisite probable cause to arrest and detain him (id. at 217-218).
