DePasquale v. Morbark Industries. Inc

In DePasquale v. Morbark Industries. Inc., 254 A.D.2d 450 (2nd Dept. 1998), the Court held that a new trial was the "appropriate remedy" where the jury's special verdict was internally inconsistent and where notes from the jury during its deliberations "evidenced persistent confusion on the issue of causation". (Id at 450.)
