Drazek v. Napoli

In Drazek v. Napoli, [23 Misc. 3d 11, 877 N.Y.S.2d 641], the Court denied the defendant's motion for summary judgment because the motion was supported solely by the testimony of the defendant's attorney and a former employee, and offered "no evidentiary materials whatsoever in support of its claim of adequate legal representation." Id. at 13-14. The Court, quoting the decision in Nevelson, noted the absence of "expert or other evidence." Id. at 13, quoting Estate of Nevelson, 259 AD2d at 284.
