Feathers v. McLucas

In Feathers v. McLucas (15 NY2d 443), plaintiff was injured as a result of an explosion in New York of a propane tank which had been manufactured outside of New York by a nondomiciliary corporation. The Court held that CPLR 302 (a) (2) does not authorize jurisdiction over a nonresident who causes tortious consequences in New York as a result of a negligent act or omission committed outside New York. The majority in Feathers stated that the plain meaning of the phrase "commits a tortious act within the state" requires that defendant's negligent act or omission occur within the state.
