Foley v. Manufacturers' & Builders' Fire Ins. Co. of New York

In Foley v. Manufacturers' & Builders' Fire Ins. Co. of New York (1897) 152 N.Y. 131 [46 N.E. 318], fire destroyed the insured's buildings while they were under construction, and the New York court held the insured had suffered an insurable loss under the pertinent fire insurance policy even though the contractors were contractually obliged to complete the destroyed buildings.
