Forgione v. Forgione

In Forgione v. Forgione, 231 A.D.2d 603, the trial court had entered a pendente lite order during the divorce action requiring the husband to designate the wife as the beneficiary of his life insurance which was designed to secure payment of a pendente lite order of maintenance. The court held that upon the death of the husband prior to judgment of divorce, all ancillary claims, such as the plaintiff wife's claim for permanent maintenance, abated so that the pendente lite order to secure maintenance could not be continued and enforced.
