Greenblatt v. Zimmerman

In Greenblatt v. Zimmerman, 132 AD 283 (1st Dept 1909), the landlord was running a restaurant and utilized the cellar for the storage of coal. The tenant obtained the lease from the landlord. Although the cellar was not part of the lease, the tenant continued the practice of storing coal in the cellar. The court found that the tenant's use of the cellar was an appurtenance as it was necessary to the restaurant business.
