Haynesworth v. City of New York

In Haynesworth v. City of New York, 251 A.D.2d 288 [2d Dept 1998], the plaintiff was shot during an altercation between rival neighborhood coalitions that took place on the street in front of a building worksite. The court found "no proof on the record that [the general contractor] had notice of any potential for criminal activity at this particular worksite. The general contractor therefore owed no duty to the plaintiff to protect him against potential injury resulting from an altercation between rival neighborhood coalitions." (Haynesworth v. City of New York, supra, 289.)
