Kellerman v. Kellerman

In Kellerman v. Kellerman, (187 AD2d 906 [3 Dept., 1992]), the Appellate Division overruled the Supreme Court's decision to allow marital fault to be considered in equitable distribution. The court noted that "defendant's conduct, which consisted predominantly of verbal harassment, threats and several acts of minor domestic violence, is in our view not so outrageous as to shock the conscience of the court and to justify his divestiture of certain of the parties' marital property." " (Id. at 908.)
