Labriola v. City of New York

In Labriola v. City of New York, (129 A.D.2d 505, 514 N.Y.S.2d 345 [1st Dept 1987], lv denied 70 N.Y.2d 604, 513 N.E.2d 1307, 519 N.Y.S.2d 1027) the plaintiff was injured after he left the street where a fireworks display had been set up to walk on the sidewalk as directed by the police. The court dismissed the claim, finding that the police made no specific promise to plaintiff as "a simple demand by the police to get on the sidewalk does not amount to the promise of safety ..." (Id.).
