Lloyd v. Town of Wheatfield

In Lloyd v. Town of Wheatfield, 67 NY2d 809 [1986], the court also concluded that a municipality enjoys absolute immunity from suit in tort for damages based on the erroneous denial of a building permit; that that immunity was founded on public policy, and that such policy-based immunity applied even though the issuance of a building permit may be compelled in an article 78 proceeding by a writ of mandamus.
