Mancheski v. Gabelli Group Capital Partners

In Mancheski v. Gabelli Group Capital Partners , 39 AD3d 499, 835 N.Y.S.2d 595 [2d Dept 2007] a trial court order sealing documents containing financial information related to non-parties, as well as the defendant's proprietary financial information, was upheld as disclosure could harm the defendant's competitive standing. There, the Second Department observed that "proprietary information, in the nature of current or future business strategies which are closely guarded by a private corporation, is akin to a trade secret, which, if disclosed, would give a competitor an unearned advantage.
