Mancusi v. Miller Brewing, Co

In Mancusi v. Miller Brewing, Co., (251 A.D.2d 265), the trial evidence showed that plaintiff sustained various facial, dental and jaw injuries as the result of a vehicular collision. In affirming the jury's verdict in favor of plaintiff, a unanimous First Department panel held that medical evidence demonstrating that plaintiff sustained permanent dental nerve loss requiring "a series of root canal treatments and significant restorative work" (at 266) was, in itself, sufficient to satisfy the statutory serious injury threshold.
