Matter of Bonacorsa v. Lindt

In Matter of Bonacorsa v. Lindt, 71 NY2d 605, the Court of Appeals held that once it is determined that a direct relationship exists in accordance with Correction Law 750(3), the factors of 753 must be considered in determining whether a license or employment should result whereas when the unreasonable risk exception is relied upon, the factors of 753 should be applied to determine whether an unreasonable risk exists in the first instance.
