Matter of Brayden UU

In Matter of Brayden UU., 116 AD3d 1179 (2nd Dep't 2014) the Second Department upheld the Family Court's finding of abuse in a case involving a five month old immobile infant who sustained a skull fracture and intracranial bleeding. The court found that the medical testimony established that the damage to the child's skull and brain was caused by significant force and could not have been accidentally caused in the manner suggested by the respondents. The court rejected the respondents' argument that other people who also cared for the child could have caused the injuries.
