In Matter of Cherrez v. Lazo (102 AD3d 782 [2d Dept 2013]) the Appellate Division affirmed an order from Family Court after a hearing was made, directing the father to pay his assigned counsel, "the difference between the amount the attorney would charge a privately retained client for the services rendered and the amount the attorney claimed from the assigned counsel plan." (Id.) Additionally, the Appellate Division supported the Support Magistrate's evaluation method "of the father's financial circumstances, including his income and the properties he owned." (Id.)
