In Matter of Cooper, 187 A.D.2d 128 [1993] the Appellate Division, Second Department, determined that the classification at issue, based on an interpretation of the Domestic Relations Law as prohibiting members of the same sex from obtaining marriage licenses, will be presumed to be valid and upheld if it is rationally related to a legitimate state interest.
