In Matter of Delicati v. Schechter (3 A.D.2d 19) a Police officer attempted to have the Court compel the Commissioner of City Personnel to select a Police Chief from among those individuals on an eligible list, of whom petitioner was one. The Court held that the Commissioner was not obligated to appoint an otherwise qualified person merely because there is no cognizable objection in law or reason.
